LEGAL BASES FOR PARTICIPATION IN THE DRAW


1.- ORGANIZING COMPANY OF THE PROMOTION

The purpose of these general conditions of participation in the Draw (the "Legal Bases") is to regulate the conditions under which users of the Instagram social network accessible at www.instagram.com (hereinafter "INSTAGRAM") can participate in the Draw .

These Legal Bases have been drafted in accordance with the provisions of current regulations applicable to the management of retail trade, random combinations for promotional purposes, defense of consumers and users, information society services and protection of personal data. staff.

The period to participate in the Sweepstakes (“Participation Period”) begins on July 17, 2023 and ends on July 24, 2023.

  1. TERRITORIAL SCOPE OF THE DRAW

The territorial area of ​​participation in the Draw (the "Territory") and, therefore, where these Legal Bases will apply is Spain, including the territories of Ceuta, Melilla, the Balearic and Canary Islands.

  1. DRAW PARTICIPATION PERIOD

The period to participate in the Sweepstakes (“Participation Period”) begins on July 17, 2023 and ends on July 24, 2023.

  1. REQUIREMENTS TO PARTICIPATE IN THE DRAW

Participation in the Sweepstakes is totally free, voluntary and free of charge, not entailing surcharges or additional fees.

Participation in the Draw implies full, full and unreserved acceptance by the Participants of these Legal Bases.

Instagram users who meet all the requirements specified below may participate in the Giveaway:

1) be of legal age;

2) be domiciled in the Sweepstakes Territory; and

3) have a real profile on the Instagram social network that corresponds to your true identity.

All those Participants who do not meet all the requirements established in these Legal Bases will be automatically discarded and excluded from the Draw by ESCORPION, without prior notice and without the right to compensation or compensation.

Likewise, the following are expressly excluded from participating in the Draw, and therefore their participation in it is prohibited:

  1. the partners or employees (regardless of the labor or commercial nature of their relationship) of ESCORPION or of any other company belonging to the same business group;
  2. the partners, employees or collaborators (regardless of the labor or commercial nature of their relationship) of the companies collaborating in this Draw or to which ESCORPION entrusts its management, organization and/or promotion and dissemination; and

iii. spouses and relatives up to the first degree of consanguinity of all the above.

  1. MECHANICS OF PARTICIPATION IN THE DRAW

On July 17, 2023, ESCORPION and BIODERMA will publish on their corporate Instagram profiles @escorpion_knitwear and @bioderma_es a collaborative post announcing the Draw and starting the Participation Period (hereinafter, the "Draw Post").

To validly participate in the Sweepstakes, each Participant must:

  1. Follow the two corporate profiles of ESCORPION and BIODERMA on Instagram until July 24, 2023, at least; and
  2. Comment on the Draw Post mentioned to one (1) friends.

It is necessary to perform all the actions of the participation mechanics correctly and completely. The comment and/or mention in any other post of the Escorpion and BIODERMA profile on Instagram other than the Draw Post; a comment without mentioning any one (1) friend; following a profile other than @escorpion_knitwear and @bioderma_es and/or the lack of any of the actions specified above as mandatory, will be considered incomplete actions and will not be valid to participate in the Draw.

Each Participant may participate in the Draw as many times as they want during the participation period, provided that in each new comment on the Draw Post the Participant mentions one (1) different friend.

All those Participants who participate in the Draw through false profiles on Instagram or using the personal data of third parties, as well as those who do not comply fully and correct with the participation mechanics specified in points (i) and (ii) above.

7.- PRIZE IDENTIFICATION

The prize will consist of 2 packs composed of:

The prize cannot be exchanged for cash or for any other prize, nor can it be subject to change or alteration. ESCORPION reserves the right to modify the prize if, on the day of declaring the participant as a winner, there are stock problems and , therefore, it is impossible to give it.

The holding of the draw, as well as the awarding of the prize, are subject to current tax regulations.

8.- METHOD AND DATE OF THE CHOICE OF THE WINNERS 

On July 25, 2023, ESCORPION will choose the two (2) winners of the Draw (the “Winners”) and two (2) alternates for each Winner (the “Alternates”) from among all those Participants who have validly participated in the Draw. through the Easypromos platform, which will select the Winners and Substitutes randomly and impartially.

ESCORPION will announce the identity of the Winners on July 25, 2023, publishing the identity of the Winners through a comment in the Draw Post of the corporate Instagram profile of ESCORPION @escorpion_knitwear and BIODERMA @bioderma_es.

In the event of interruption of the Draw for any technical reason or reason unrelated to Escorpion once the Draw has started, the interrupted Draw will be automatically cancelled, together with the actions and results that it has produced and ESCORPIO will start a new draw from the beginning.

9.- PRIZE DELIVERY CONDITIONS

On July 25, Escorpion will contact them to inform them of their status as Winners by private message on their Instagram social network profiles, so that they can confirm their acceptance of the Prize and coordinate its delivery.

The Winners will have a period of seven (7) days from the receipt of the private message sent by ESCORPION to confirm whether or not they accept the Prize. Each Winner must confirm to Escorpion by private Instagram message the acceptance of the Prize, providing their address and contact information for this purpose.

In the event that Escorpion does not receive the aforementioned confirmation message from the Winners in a timely manner, Escorpion will automatically disqualify said Winner without prior notice and without any right to compensation, the latter losing their right to obtain the Prize. In such a case, SCORPIO will contact the Substitute by private Instagram message.

The Substitute must confirm to Escorpion by private Instagram message the acceptance of the Prize within a maximum period of 7 (7) days, including his address and contact information. In the event that Escorpion does not receive the aforementioned private confirmation message from the Substitute in a timely manner, Escorpion will automatically disqualify said Substitute without prior notice and without any right to compensation, the latter losing their right to obtain the Prize.

ESCORPION reserves the right to declare the Draw void in the event that (i) it does not receive in due time and form from the Winners and/or Substitutes the contact information for the correct acceptance of the Prize; (ii) the Winners and/or Substitutes reject or renounce the Prize for any reason; (iii) the Winners and/or Substitutes do not meet the participation requirements established in these Legal Bases or in any way violate, breach or contradict what is stipulated therein; and/or (iv) for reasons of fortuitous event or force majeure.

The resignation of the Prize by any Winner or Substitute will not grant the latter any right to indemnity or compensation from ESCORPION.

The Prize is of a very personal nature, so in no case and under no circumstances will the sudden impossibility of taking advantage of the Prize by a Winner and/or Substitute lead to its substitution by a third party.




10.- DISQUALIFICATIONS AND PENALTIES

If it is evident that any of the participants does not meet the requirements set forth in the bases, or the data provided to participate is not valid, their participation will be considered void and they will be automatically excluded from the promotion, losing all rights to the prizes awarded by virtue of this Promotion.

SCORPIO reserves the right to declare the draw void.

11.- PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions whose content is considered inappropriate, that are offensive, insulting or discriminatory or that could violate the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honor, personal and family privacy and one's own image will not be allowed either. We will not be responsible for the damages caused by the comments made by the Participants in the Promotion, and that at any time could hurt the sensitivity of other Participants.

Participation in this Promotion, as well as the publication of the comments made by the Participants in the publications, may not under any circumstances violate the Instagram Community Rules or the Conditions of Use from Instagram. 

If the use of fraudulent means for participation is discovered by Escorpion, such as the use of bots in the comments, the prize will not be awarded and will remain the property of Escorpion

12.-RELEASE OF LIABILITY

By way of example, but not limitation, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the participant regarding the prize you get from this Promotion.

We do not assume responsibility in cases of force majeure or fortuitous events that could prevent the completion of the promotion or the total or partial enjoyment of the prize.

In the event that this promotion could not be carried out, either due to fraud detected in it, technical errors, or any other reason that is not under the control of the company and that affects the normal development of the contest, we reserve the right to cancel, modify, or suspend it, including the participation web page.


13.- PROTECTION OF PERSONAL DATA


ESCORPION, as data controller, will process the personal data of the Participants for the following purposes: manage their correct participation in the Draw; publish your identity as the Sweepstakes Winner, if any; manage the delivery of the Prize in the event that it is the Winner of the Draw; manage any incident, request for information or claim related to or derived from the Draw and the participation in it of the Participants; and comply with the legal obligations required of SCORPIO

That is why the Participant declares to have been informed of the conditions on protection of personal data, accepting and consenting to the treatment.

14.- CHANGES AND ACCEPTANCE

We reserve the right to modify or expand these promotional bases, to the extent that it does not harm or impair the rights of the Participants in the Promotion.

The mere fact of participating in the draw implies that the Participant fully accepts the conditions of these Legal Bases. Likewise, participation in a draw of this nature implies acceptance of the rules of the Instagram social network through which it is carried out.

15.- APPLICABLE LAW AND JURISDICTION

These legal bases will be governed in accordance with Spanish law. The Courts and Tribunals of the Participant's city of residence will be competent to resolve any claim or controversy that may arise in relation to the validity, interpretation or compliance with these bases.
